Brendan concentrates his practice on representing business clients in a wide range of complex commercial litigation matters. Brendan has dealt with issues involving: commercial contracts and the Uniform Commercial Code, trademark infringement, eminent domain and property rights (including private road act/cartway statute litigation), antitrust, unfair competition, trade secrets, restrictive covenants, franchise disputes, commercial landlord-tenant disputes, securities violations, product liability and toxic torts, ERISA subrogation, First Amendment and insurance coverage.
Brendan has litigated matters in state trial and appellate courts, federal district courts and in the Third Circuit Court of Appeals, and in alternative dispute resolution proceedings through mediation and AAA arbitration. He has significant experience in all aspects of pre-trial practice and procedure, and has served as 1st and 2nd chair counsel in trials and injunction hearings in state and federal court.
Some of Brendan's representations as lead counsel include cases where he:
- Won a verdict in favor of a municipal water authority worth more than a half million dollars after a two-day non-jury trial of a declaratory judgment action concerning the interpretation and enforceability of a long-term water supply contract; the verdict was affirmed by the Commonwealth Court of Pennsylvania in a reported decision. The Municipal Authority of the Borough of Edgeworth v. Borough of Ambridge Water Authority, 936 A.2d 538 (Pa. Commw. Ct. 2007);
- Won summary judgment on behalf of beneficiaries of a health care plan against claims by the plan under ERISA seeking reimbursement of $236,744 for medical expenses paid by the plan from the proceeds of a malpractice settlement obtained by the beneficiaries. ACS/Primax v. Polan, 2008 WL 5213093, CA No. 07-00170 (W.D. Pa. Dec. 12, 2008);
- Won a verdict for $113,839 in damages, plus attorneys' fees, after a two-day non-jury trial in favor of a landlord against a commercial tenant, and a verdict against the tenant on its counterclaim. Urban Growth Property-Everest Pittsburgh, LLC v. Melody Corp. et al., No. GD-06-005911 (Alleg. Cty. Pa. June 10, 2008);
- Won a defense verdict for a Fortune 1000 company after a two-day non-jury trial against claims that the company had breached its commercial lease. Newman v. Regis Corp., No. AR-05-000640 (Alleg. Cty. Pa. March 21, 2006);
- Won a defense verdict for a commercial insurance broker after a three-day non-jury trial against claims that the broker had been negligent in procuring an insurance policy. School Facility Development, Inc. v. Penn-America Ins. Co. et. al., No. GD-04-022099 (Alleg. Cty. Pa. June 6, 2006);
Brendan was previously a senior associate with Buchanan Ingersoll & Rooney, P.C., where he practiced for six years. He participated in Buchanan Ingersoll's summer associate program in 2002 and was also a summer associate with Womble Carlyle Sandridge & Rice in Winston-Salem, North Carolina in 2001 and 2002.
While in law school, Brendan was active in the Lile Moot Court Competition and was awarded the Bracewell and Patterson Oral Advocacy Award.
Prior to entering law school, Brendan attended Stanford University, where he graduated in three years, earning Phi Beta Kappa honors and receiving his bachelor of arts degree in history with distinction.
Brendan is admitted to practice law in Pennsylvania, in the United States District Courts of the Eastern and Western District of Pennsylvania and in the United States Court of Appeals for the Third Circuit.
